Blake Hall goes to jail
Blake Hall, former Repub bigshot from Idaho Falls, was sentenced yesterday after earlier pleading guilty to a stalking charge.
Hall's ex-girlfriend filed a complaint earlier this year, and court proceedings were slowed by Hall's association with the City of Idaho Falls, because he was a paid assistant and consultant to the city prosecutor, Dane Watkins II. In addition, Hall was also connected or well known to all the local judiciary.
A retired (as I recall) judge from Twin Falls eventually heard the case, which was prosecuted by an attorney from the State Attorney General's office. Hall pled guilty a couple of months ago, and there was an extensive pre-sentence investigation. The judge threw the book at him, calling the case "The most severe and longest lasting case of stalking he had heard, and he had heard thousands of these cases." (this is not a direct quote. It's a summary.)
Hall was sentenced to 15 days of jail time (15 more suspended), a year's probation and a $1000 fine. He apologized to the woman, who is now married, and to the community. Little of the specifics of the case were publicly mentioned by the media, but apparently Hall continued his stalking after the woman married another guy. Both Hall and the woman were single when their affair began, but (apparently again) she grew tired of him and dumped him, which started the stalking.
Hall was the former head of the Idaho Education Dept. board, and under his leadership effectively took away the powers of the elected Supervisor of Education. His micro-management of the board and of the Ed Department's money caused many problems that are still being dealt with. In addition, Hall was a Sergeant At Arms at several Republican conventions, and was video'd removing a protestor from the 2009 convention. As far as I know, he is still an Idaho delegate to the national Republican Party, but has given up his other positions in the State and National parties.
I don't know if he is going to be disbarred, if his church will excommunicate him, or what other penalties he may face. I'm pretty sure he's all done with his Idaho Falls contract, but I don't know if his law office will continue with the city, using another lawyer.
Halls' former wife, Lauren, is also a mover and shaker among the Idaho Repubs. After their divorce, Lauren married the owner of the Mountain View hospital in I.F. in a temple ceremony held in Utah.
Will Hall become another Repub persona non-grata? Maybe, but I tend to doubt it. The women around here are all happy he got the slammer, but the Idaho Repubs seem to have a tin ear when it comes to their womenfolk. In the past, Hall was a quiet power behind Kempthorne's throne, but it remains to be seen whether he will become something similar in the future.

Thanks Mike. Judge Don Harding indeed threw the book at him, giving him six months jail (the max), suspending all but fifteen days, pending successful completion of supervised probation for one year. I got a kind of visceral sense of satisfaction knowing that he wasn't expecting anything of the sort being not only a first time offender, but one who believed he was beyond the reach of this type of justice.
Interesting that there continues to be a news blackout on this. Popkey had a minor blurb which surprises me since the details appear quite salacious. Heres the KIDK link which barely scratches the surface. I can't tell if he gave an Alford plea which they imply. An Alford plea is technically a plea that says the prosecutor can get a conviction but the defendant doesn't technically agree that he did it.

Alford plea
Out of curiosity, I looked up more about the so-called Alford plea.
"...the defendant does not admit the act and asserts innocence, but admits that sufficient evidence exists with which the prosecution could likely convince a judge or jury to find the defendant guilty."
I can see you're going to convict me, so I give up. Sounds like a rather unconvincing claim to innocence.
The lawyers will know better what technical advantage it might convey; for future reference, it counts as "guilty." And indeed, as captured on the KIDK video excerpt of the proceedings, Hall admitted inappropriate behavior. The Judge noted that it was inappropriate to an exceptional degree. Still, a misdemeanor conviction.

actually, and used when one anticipates a civil claim for damages to preserve deniability or when parsing things with the media. It definitely counts as guilty.
David Leroy
was the defense attorney. Thanks for the video heads up Tom, I missed it. People will recall former Lt. Governor Dave Leroy. He practices law in Boise out of his residence and shows up on many high profile Republican cases where the defendant can afford his fee.
They threw themselves on the mercy of the court. Guess Dave didn't have much to work with.

The most you can get
for misdemeanors is six months. Maybe he said six years but its only six months.

Inconsistencies
If this was truly among the longest lasting and most severe cases that a criminal judge (of all people) had ever seen, then why wasn't Hall charged and convicted of a felony?
Looking for work
So, he's out as deputy prosecuting attorney for Bonneville Co., after 26 years in that job. But Fremont County is keeping him on his $31k/year job there. The Prosecutor who hired him in January, Joette Lookabaugh thinks this is just "political glee in striking down the well-known for any real or perceived foible."
Either that, or maybe removing from power those who abuse their power in outrageous ways, Joette? (Are you sure you're qualified for your job? Just sayin'. I mean, you are a Republican and everything, but still.)
He's already quit his RNC general counsel and State Board of Education jobs, but he still has a private law practice, and is administrator of the state Catastrophic Health Care Program and an attorney for the Idaho Counties Risk Management Program, or ICRMP.
I don't imagine so much work will keep rolling in, but who knows? He could join Larry Craig's lobbying company maybe.

More Hall details
The Post-Register let out some details of the stalking incidents this morning.
Hall allegedly had a Bonneville County deputy fired for going out with the victim after one of her breakups with Hall. There were 3 breakups before he quit the relationship.
Hall confronted the woman several times in public; once at a dept. store, where he took her keys and wouildn't let her leave until she talked to him, once at a burger joint when he began crying, once when she was on a date with another guy. Hall shadowed them at a restaurant, then confronted them in front of the local theatre complex. On that occasion, she had a few brief words, then kicked a front door to the theatre.
He also entered her house without permission, and found her upstairs, half-dressed. He had a major confrontation with her at that time, and she called a girlfriend. The girlfriend came and got her, and Hall jumped in the car with them, but exited soon after.
There were several other instances, both private and public. The tone of the report gave me a feeiling that Hall was all tipped over emotionally, and was acting pretty much like a jilted kid. Apparently, Hall didn't ever assault her, but he did a fair amount of public sobbing and humiliation. (for them both, I think). He was once run off her place by a later boyfriend and his son.
The paper also blasted Lookabaugh in an editorial for her retaining Hall as outside counsel for Fremont County.
Hall resigned his nat. Repub Committee seat last week, and Danke Watkins Jr., the Bonneville County prosecutor, fired him from his assistant counsel job Monday. Hall held the job for 23 years, and was paid $60,000 yearly. He was prosecuted and sentenced under a misdemeanor charge, and got the max the charge allowed. I don't know if an Alford plea was entered or not.
I forgot to mention that Dave LeRoy was Hall's defense counsel... he's looking old these days, and didn't have much to say in court. Hall disagreed with some of the victim's testimony, but it looked like parsing to me.
Bonneville County is rapidly losing it's powerful old guard Repubs. The local Central Committee is in some territorial pissings with Shiela Olsen and Kathy Stanger, both long-time party activists. Olsen's late husband was the State Repub Chairman for years before his death. The disagreement stems from the recent local election. Larry Lyon is quite active now, and is one of the local CC.
Dane Watkins Jr. seems to have no desire for higher office at present, but if he is, he will have his father's reputation to contend with. Watkins Sr. was once an Idaho Senator who lost re-election after voting against local farmers in a water use dispute, and was briefly infamous for 'tabling' a critical bill by hiding it in the trunk of his car.
Tom Loertscher seems to be the last of the old guard who isn't in trouble right now. He's from Iona, a small town about 5 miles from Idaho Falls, and is one of the most rabid conservatives in the state legislature.

Hall, and/or his 'surrogate' son, dropped a total of 19 used condoms and an empty box on the now-married girlfriend's driveway. Hall was non-responding until the police lab collected samples for DNA testing. Since he pled guilty, no DNA testing was recommended. Hufpo's responses were mostly very creeped out with that tidbit.

Let me see if I understand this correctly, Jane John Doe (if that is your real name...) -- due to the fact that this particular woman was schtupping Bad Blake whilst at the same time being married to another man, she is, as you say, "as bad as Blake Hall"? Really?
Hall went to jail for a day over a fortnight after being convicted of the crime of stalking. He repeatedly followed the victim to her home, to restaurants and movies, and refused to leave her alone even after she requested he go away. Hall repeatedly threw used condoms onto her lawn ('cause nothing says "I love you!" like spooge balloons across the front yard) and stole her keys in Wal-Mart and wouldn't give them back unless she agreed to listen to his rantings about wanting to marry her.
She, you say, was a married woman at the time she porked Blakey-poo, so, ipso-facto, she was exactly as guilty as him. Wow. I'm surprised the judge didn't throw her in prison for a year and force her to wear a scarlet "A". After all, that sounds as bad or worse than everything the Blakester was convicted of, don'cha think?

He did the police report, she was going to retaliate by throwing the condoms back on his lawn, by her own admission. Doesn't appear that she tried to get rid of BH. Start with the initial police report. It is filed by Dr Chambers, not the Mrs. In the police report she admitted to driving by BH's house with friends, to texting him etc. She is attempting to sound like a victim when she was playing games with BH as much as he was with her.
Talk to anyone who has been truly a victim of stalking and they will tell you they changed phone numbers, they called the police on their offender, they did anything to avoid contact with the stalker. She fueled the fire and not any better than BH.

He did not which was wise cause the judge would have sentenced him to the entire six months for lack of remorse.
